Chad Daybell Trial: Detective Vince Kaaiakamanu Finishes His Testimoney.

 
It was Day 11 of the Chad Daybell trial and Detective Vince Kaaiakamanu was back on the stand.

Blake published a PowerPoint that Vince put together from investigating Alex's Google searches.

October 8th, 2019, the day before the attempted shooting of Tammy Daybell. - Alex Cox Googled “the 100-yard drop to 200 and 100 to 300.” Vince explained "During shooting and sighting in your rifle with your scope, depending on how far you're out in yardage, a lot of times you will dial in that scope to a precise point of impact of your bullet. The drop of your bullet the further you're out. The drop of the bullet tends to go down a little bit."

Vince confirmed that it was a 6.5 grindle specifically that Alex searched for information for. He also confirmed that the rifle recovered from Alex's apartment was a 6.5 grindle.

October 9th, 2019- Alex searched for uppers or ARs, muzzle energy break of a 6.5 grindle and frog sizing of frog tog pants.

Vince said that there were some frog tog pants purchased that day from Sportsman's Wearhouse in Idaho Falls. He also confirmed that a device belonging to Alex was at the Sportsman's Wearhouse that day and that the Frog Tog pants were black.

October 10th, 2019- Alex searched for how an AR responds to cold weather, if an AR responds in cold weather, Hornady one shot, shooting in cold weather, how to prep your AR to shoot in cold weather and if mag rang shrinks in cold weather.

Vince testified that that part of Idaho where Tammy lived was generally cold. He said that he Googled the temperature for the day of Tammy's shooting, and it was 26 degrees Celsius.

October 12th, 2019- Alex searched how to attach a ghillie suit, a cover to a ghillie suit, if a 6.5 grindle will shoot through a windshield, the penetration through a Dodge Dakota 2008, Dodge Dakota steel body thickness, the thickness of the doors and how thick a 22 gauge still is.

Vince said that a ghillie suit is used a lot in the military. It is a cover that snipers can use while they are in the weeds, the brush and the trees so they are not seen.

Vince said that Tammy and Chad had a 2004 Dodge Dakota registered to them.

Blake asked Vince if he also looked at some shooting range records. Blake admitted financial records from gun range. She asked Vince if he was able to determine if Alex had been at that gun range. He said yes and that Alex signed in as C. Quint on the sign-up sheets. Vince said that CPQUINT was on Alex's license plate on his Ford F-150 truck. Vince said that Alex was there five times from October 7th to October 15th, 2019.

Vince reminded the court that Tammy was shot at on October 9th and was pronounce dead on October 19th, 2019.

Blake admitted an Affidavit of records from Tammy’s phone. Tammy sent Mark Daybell an email on October 13th, 2019. Vince read the first paragraph into the record.

" I think I was a bit shocked because I just said what do you think you were doing? Then I noticed the rifle is actually a paintball gun it had a hopper on top. The guy started pulling the trigger and I could hear the clicking and whooshing sound of an empty paintball gun. He stayed standing by the back of the car just pulling the trigger while pointing the gun at him for some reason. I just kept asking him what he thought he was doing. At that point I was actually more annoyed than scared because he was standing between me, and the door and he didn't step towards me or even say anything. The scared part came after when my brain thought of things that could have happened."

Vince then read the last sentence of the second paragraph.

"Well, Thursday night though I didn't go to Zumba because I was quite understandably did not want to be out after dark alone."

Blake asked Vince if in the first paragraph Tammy referred to the rifle as a paintball gun. He said correct. Vince confirmed that Tammy referenced a hopper. He also confirmed that Tammy said that he kept pulling the trigger. Blake asked if Vince could see where Tammy said she was scared. Vince said yes.

Blake published a photo of the 6.5 grindle that was found inside Alex’s apartment. Vince confirmed that had a large scope on top that could be mistaken for a hopper.

Blake talked about how Alex Googled drilling a baffle to make a suppressor. Vince said that a suppressor is a device that can be screwed onto the end of rifles, handguns and mini guns, that will make the bullet coming out quiet. He said that sometimes people make homemade suppressors where they have to drill holes.

Blake admitted a close-up photo of the rifle. Vince said that "It is threaded and sometimes you can get muzzle breaks on there or you can take a muzzle break of and put a suppressor on there."

Vince testified that a device associated with Alex went around the Daybell residence the afternoon of the “attempted shooting” of Tammy. And later that day the same device was at the Sportsman's Wearhouse.

Vince testified that there were no paintball guns located at Alex's apartment.

Blake talked about Geofencing. Vince testified that the Geofencing data that he gathered showed Alex's device was at the Salem church, which was 2.6 miles from Chad's house, on October 18th, 2019, at 10:07pm to 10:45pm. He said that the device then shut off and when it came back on it was 11:53pm it was 7 miles south of the church.

Blake asked Vince who was the person who saw Tammy last besides Chad. Vince said Tammy's son Garth. Vince testified that Garth was at work at the Haunted Mill until 1am the next morning.

Vince testified that Chad's devices did not show up that night at either location. Vince said that Chad had told the police that he had been home that night.

Blake talked about the emails that Charles had sent to Tammy and Chad. Vince said that the email to Tammy had been sent on June 29, 2019, to her school address telling her he had information about an affair going on. Vince said that Charles didn't give too much information but did include his phone number for her to call him. Vince said that he was never able to confirm if Tammy had contacted Charles.

Vince said that on the same day that Charles sent Tammy the email, he sent Chad an email as well telling him that he knew what was going on between him and Lori and Chad needed to tell Tammy or Charles was going to expose him. Charles said that he was also aware that Lori had sent Chad some dance videos of her and that was inappropriate.

Vince testified that in his investigation he learned that Chad and Lori got married on November 5th, 2019, just three days after Tammy's funeral.

Blake had no further questions.

Prior was up for the cross. Prior displayed the email Tammy had sent to Mark about the shooting incident. Prior talked about Reagan Price lived “kiddy-corner” to the Daybell house. Price reported that someone snatched her dog earlier the week of the attempted shooting. 

Prior asked Vince where the attempted shooting took place in relation to the Daybell house, which was behind her car and next to the garage.

Prior had Vince read a line from the email.

"Then I noticed the rifle was actually a paintball gun, it had a hopper on top." 

Vince testified that he knew the difference between a paintball hopper and a rifle scope. Prior claimed that it would be very difficult to confuse a hopper and a rifle scope. Vince disagreed and said that someone who didn't not know the difference could make that confusion.

Prior said that Tammy Googled photos of paintball guns and pointed out the one she saw the night of the incident. Vince said that he did not know about that because it was not included in police reports.

The court took a break. When they returned Prior asked Vince to read from the email again.

"I think I was a bit in shock because I just said, 'What do you think you are doing' then I noticed the rifle was actually a paintball gun, it had a hopper on top."

Prior said the next line said, "The guy started pulling the trigger and I could hear the clicking and the 'whooshing sound' of an empty paintball gun." Vince said that was correct.


Prior read more.
"He stayed there standing by the back of the car, just pulling the trigger while pointing the gun at me. For some reason I just kept asking him what he thought he was doing."

Prior suggested that because Tammy was at close range to the man, she would have known what was being pointed at her. Vince said in daylight yes.

Vince agreed that unless they had the weapon, they wouldn't know exactly what it was.

Prior said that an AR, even with a suppressor, would make a noise loud and that Garth and Chad would have heard it go off. Vince said it depended on the type of round used.

Prior read another line.

"They suspect that it was a bipolar teenager who lives down the street and walks around a lot."

Vince agreed that it is unclear who the "we" in the email was.

Prior asked Vince if he was aware of a bipolar teenager contacting people in the neighborhood. Vince said he was not. 

Prior read another line.

"His theory is that the crazy dog lady brought her husband back to steal the dog again. They had parked down the road and had snuck through the cow fields and he was going to cut through our front yard."

Prior read another line.

"When I pulled up and startled him, he didn't know what to do so he panicked and tried to menace me with his not real gun."

Prior said that it was clear that Tammy knew that the gun was not real.

Prior read more.

"So, then he ran back across the field, which would explain why he ran across the side of the house. I never heard a car and could never find anywhere."

"It is actually a pretty good theory."

Prior asked Vince if he talked to Reagan or Matt Price. He said yes. He also agreed that the alleged dog incident happened the same day that Tammy was shot at.

Prior had Vince read a line from the email.

"Honestly, I just kept wondering what kind of person walks around with a ski mask on carrying an empty paintball gun. Bipolar doesn't mean you want to hurt people, so I am leaning more towards Matt's theory. The guy didn't try to rob me or even really hurt me. On Thursday night though, I didn't go to Zumba because quite understandably I did not want to be out after dark alone."

Prior played the call twice to dispatch that Tammy placed about the shooting. 

Prior said that the call spoke for itself. Vince said “Yes. Having a rifle and shooting at her.”

Prior then published a photo of a paintball gun. He said that someone can clearly see the hopper. Vince said if they are clearly able to see it.

Prior had Vince read part of the Facebook post Tammy had written about the attempted shooting.

"Something really weird just happened, and I want you to know so you can watch out. I had gotten home and parked in our front driveway. As I was getting stuff out of the back seat, a guy wearing a ski mask was suddenly standing by the back of my car with a paintball gun. He shot at me several times, although I don’t think it was loaded."

Prior points out that Tammy never included the words “gun” or “rifle”.

Prior displayed and exhibit that showed Tammy searched paintball guns and airsoft guns on October 10th at 9:29pm. Vince said that he did not see in police reports anything about that search.

Prior said only Tammy and the gunman were present for the incident and Tammy would have been the only person to identify the instrument.

Blake asked Vince if he knew what Tammy’s knowledge of guns was. He said that he had no way of knowing that, as he never spoke to her directly.

Prior published Alex's Google history again. Vince confirmed that Alex had he visited the Freemont County gun range October 7th to the 16th. Vince said that Alex had also visited gun ranges in other cities. Prior said that Alex had a habit of visiting gun ranges. He also alleged that Alex had been Googling guns as early as 2017. Vince said that he was not aware of those searches.

Prior asked Vince if he was aware of the incidents involving Brandon Boudreaux and Charles Vallow. He said yes. Prior said it is alleged that Alex shot at Brandon from a distance and at close range at Charles and killed him. Vince agreed. Prior stated that Chad was not implicated in those incidents. Vince agreed.

Alex searched “drop for 100-200 yards.” Prior said that the driveway was around 30 feet, which is 10 yards.

Prior asked Vince if there was an indication that Alex had purchased a hunting license. He said that he was not aware but acknowledged that it would have been hunting season. He also agreed that a grindle could be used for hunting as wells as a ghillie suit.

Alex Search for preparing an AR for cold weather. Prior said that October would have been a cold time to go hunting. Vince agreed. Prior mentioned the search that Alex did for bullets that could go through car doors and windshields.

Prior said that it looked like Alex had been planning to shoot a Dodge Dakota and to do harm to whomever was driving it. Vince said yes. Prior tried to insinuate that Chad was Alex's target, not Tammy.

Prior published a copy of a police report written by Vince.  Vince confirmed that he had went through all the information from Tammy’s email account and included all the information in his report he felt relevant. Some of what he found relevant was emails between Tammy and Mark while he was on his mission as well as messages between Tammy and her other children. 

In his report Vince said that it was clear that Chad was messaging and using Tammy's email. He also said that there was evidence that Tammy and the kids had knowledge that Chad believed in light and dark people.

Prior read and excerpt from Vince's report.

"During the chats Mark's camera was not working and Tammy informed him that his camera was cursed, and dad was removing it. In more chats Mark asked if anything was found for notable in him when he was body coded."

Prior read another excerpt from the report.

"Tammy responds 'You has a lot of weapons, negative cords and curses, plus trapped emotions. We cleared out quite a bit, we'll do that more regularly for you.'"

Prior said that "we cleared it out" meant Tammy and Chad did it together. Vince agreed.

Prior read more.

"Another chat Chad said 'Mom and I taught 10-year-old Sunday school yesterday. Canyon Scott's actions confirmed he is a 4.2 dark. I will enjoy watching his growth to the world terror and domination.'"

"Emma said 'I like Canyon though.'"

"Tammy and Chad replied 'Unfortunately, he's already influencing Will Dalling.'"

"Mark says 'I like Jose also.'"

"Mary says 'Darkness is interesting.'"

"Tammy and Chad both say 'Maybe they are influencing you too. They are charming.'"

Court took a break, when they returned Prior continued to go over Vince's report. Prior had Vince read an email from Julie Rowe to Tammy dated March 12th, 2019.

"Chad, I met with the stake president last night and he has requested we stop publishing all my books. I told him I do not have the rights to the books and that my publisher has all the rights. He asked me to contact you to request that we stop publishing. He has asked me to copy him on this email and send him your reply, yep. He also said he is going to contact your stake president. Julie."

Vince explained that a Stake president is president over the wards. Prior asked Vince, why a Stake president would interject himself in the publishing of books. Vince didn't know.

Prior read the next email which was from Tammy to Mark on March 31st 2019. 

"Dad and Garth doing a C25K (couch to 5k) with me." 

Prior then basically called Chad a couch potato. He then read more of the email.

"We've done the first week twice because quite frankly I didn't feel ready to move on to the second week, but it should be good for us. OK, good for me. I have to say, I admire you for running track. Starting from nothing is not easy."

Prior then read an email from April 14th, 2019, from Tammy to Mark.

"I tripped over the duck gate on Saturday and landed hard on my right hand and the bucket of eggs I was carrying. It hurt so bad, I just lay in the driveway and cried. But I got up and cleaned up the egg mess with my left hand and went in the house to find dad. Luckily, I seemed to have only bruised it. Of course, dad blessed it, so it may have been worse."

Vince said during the investigation it was said that Tammy had a hurt wrist and that she was taking medication for it. He said that instead of a possible fainting spell, she had tripped over a duck gate.

Prior read another email from Tammy to Mark. This one from April 28th, 2019.

"Dad is in Houston and won't be back until Monday night, so you will just have to talk to me until tomorrow."

Vince said that the email correlated with some of the other records that showed Chad was in Houston and Tammy was home alone.

Prior read an email to Mark saying that she hadn't sleep well since Chad was gone.

Prior then read and email from June 30th, 2019, from Tammy to Mark about Chad shooting a raccoon at their house.

"Another adventure we had this week involves a raccoon. Last year we had skunks, this year a raccoon. We thought that stray cats were getting into the cat food but nope, Garth saw it one night and it was a raccoon. We borrowed a little trap from Matt Price, but when Garth went out to check it that night the raccoon ran up the tree by the trap. It was huge. No way it was going to fit in the trap, it was larger than Chase and had really long teeth. Garth kept his flashlight on it and called us in the house. Dad got his gun, shot it out of the tree, then shot it again as it tried to run across the yard. We now have a raccoon buried in the compost heap. Something else got into a cat food a couple of nights ago, so we borrowed a larger trap from Matt. We didn't catch anything last night, so we'll see if we get anything tonight. If we do get anything, Matt asked us not to shoot it because he has a friend who'll use whatever we catch to train dogs. Joel Nickle told me that they have a couple of raccoons and skunks they've been trying to trap, and some coyotes have been eating chickens at houses over by Jordan Grahams house. In all it's been a crazy year with wildlife."

Prior read another email from Tammy to Mark on July 7th, 2019.

"Here is the second raccoon, the first one was shot. Garth said this one is smaller than the first one. I like how the kittens are looking at him too."

Prior published two photos, one was of Chad and Tammy, and one was of a raccoon in a trap.

Prior read more of the email.

"Dad has lost a lot of weight, he doesn't seem to each much anymore and he is exercising."

Prior read another email.

"Dad is speaking to a small group on Sunday night and at a girls' camp on Monday night. He flies home on Tuesday."

Vince confirms that that email was in reference to the meeting at Lori's house with Gibb and the other ladies.

Prior then reads an email from September 15th, 2019, from Tammy to Mark about Tammy not feeling well.

"This was taken on Saturday. Joe planted potatoes in his garden. I had been sick in bed all day with a really bad cold, but I put on a hat and went and posed for this picture. So, it looks like I am a real Idahoan, but I went right back to bed after we took it. I'm still sick today and my nose won't stop running. I will go to work tomorrow though because I am helping with testing and getting sub work would be more trouble than it was worth."

Prior read, "Your mom came to visit us Friday night and Saturday morning. Under orders from Grandma Cooper, I'll let her tell the story."

Vince said that was from Mark's grandpa, Ron Douglas, to Mark. He said that through the investigation he learned that Tammy did not drive very far alone. Vince said so it was unusual for Tammy to drive to Utah, which was 3 and a half hours away, by herself. The email was from October 6th, 2019.

"I went down to Springville by myself October 6. I drove there by myself and then drove home by myself. I am a big girl now. I can tell you more about this in a bit."

Vince testified that he spoke with Officer Greenhalgh about her investigation into Tammy’s unattended death. and that nothing suspicious was reported.

Prior was finished with his questioning.

Blake was up for the re-direct. She asked Vince who rated people light or dark. Vince said it was Chad. Blake said that Chad had rated some 12-year-old children as dark. Blake asked Vince if they are alive. He said he hoped so. Blake asked him if those children stood between Chad and Lori being involved. Vince said no.

Blake said that in Tammy's emails she told her Mark she had not been sleeping well with Chad gone. Blake pointed out that Chad was in Houston with Lori at that time.

Blake talked about how in the emails about the raccoon it appeared it was shot at night. Vince agreed. Blake asked Vince if he recalled seeing an email from Tammy to Mark about a raccoon in September of 2019. He said he did not.

Blake then talked about the email in August of 2019 about Chad being at a Girls' camp. Blake asked Vince if Chad was at a girls' camp. Vince said that he was at a conference at Lori's house.

Blake talked about Tammy's email from September 15th, 2019, saying that she had a cold. Blake asked Vince if there was any similar email in October of that year saying she was sick. Vince said no.

Blake then talked about the emails from Tammy and her father Ron to Mark on October 6th, 2019, where Tammy had visited Ron. Blake asked Vince if he learned through his investigation who had encouraged Tammy to go visit. Vince said yes, Chad did.

Blake then talked about the attempted shooting of Tammy. Blake said that Regan had said that that day a lady had tried to steal her dog. Vince agreed. Blake asked Vince if Regan had saying about the lady having a firearm. Vince said no. Blake asked Vince if Regan had mentioned that the lady was all in black. Vince said no.

Blake asked Vince how many driveways were at the Daybell residents. Vince said there was two and that the back driveway was much longer compared to the one in front.

Blake said that the attempted shooting of Tammy took place a little after 9pm. She asked Vince if it was dark then. Vince said that it was around dusk.

Blake asked Vince if he knew how familiar Tammy was with guns. Vince said he had no idea.

Vince said that he was not surprised deputy did not search the internet for photos of paintball guns with Tammy.

Blake said that Tammy had Googled paintball and airsoft guns. Blake asked Vince if she ever produced a photo saying that it as the one that had been used to shoot at her. Vince said no.

Blake asked Vince if there were various types of paintball guns. Vince said yes. 

Blake then published a photo. The top gun is the Grindle that was seized from Alex's apartment. And the bottom gun is an example of a Tipmen paintball gun with a hopper on the top and a collapsable stock on the back and then the barrel.

Blake showed a close-up again of the grindle's barrel, which is similar to the paintball gun's barrel. 

Blake pointed out that Alex was near the Daybell residence on the day that Tammy was shot at as well as the night before Tammy was pronounced dead. Vince agreed.

Blake asked Vince to compare the sounds of a paintball gun and a misfiring AR with a suppressor. He said there are different sounds, depending on the cause of the misfire.

Blake asked Vince if there were any police reports filed around the time of the attempted shooting of a bipolar neighbor brandishing a gun of any kind. Vince said no.

Blake had Vince read part of the Facebook post Tammy had written about the attempted shooting.

"Something really weird just happened, and I want you to know so you can watch out."

Blake then read part of the email Tammy sent Mark Daybell on October 13th, 2019. 

"The scared part came after when my brain thought of things that could have happened."

Blake then read, "I didn't go to Zumba because quite understandably I did not want to be out after dark alone."

Blake asked Vince if those statements indicated someone scared by something that has happened.

Blake read, "The guy started pulling the trigger and I could hear the clicking and whooshing sound of an empty paintball gun. He was standing by the back of the car just pulling the trigger while pointing the gun at me."

Blake asked Vince if this indicated that someone more than pointing a gun. Vince said yes.

Blake asked Vince if he recalled in Tammy's call to dispatch where she said that someone had pointed a gun at her and was just shooting. Vince couldn't recall, so the call to dispatch was played again.

Blake asked Vince if he heard where Tammy said, "'Holding a gun like he had a rifle and shooting at me, but nothing came out.'" Vince said that he did. Blake asked him if that sounded like something more than someone pointing a gun. Vince said yes.

Blake then talked about the searches that Alex had done and how Prior had said it was hunting season. Blake then asked Vince if shooting through the windshield or the door of a Dodge Dakota had anything to do with hunting. Vince said no.

Blake asked Vince if he learned though his investigation if Chad had deemed Alex as Lori's protector. Vince said yes Chad had.

Blake asked Vince if after Charles was shot and killed on July 11th of 2019, did Lori and Chad maintain a relationship. Vince said yes. Blake said that we saw in an email how Chad had been visiting Lori in August of 2019, just three weeks after Charles had been killed by Alex. Vince agreed. Blake asked Vince if that led him to believe that Chad was scared of Alex. Vince said no. Blake asked Vince if he believe that Chad was scared of Lori. Vince said no. Blake asked Vince if Chad had reported to the Freemont police that he was afraid of anyone or that if anyone had tried to shoot at him. He said no.

Blake asked Vince what he learned through the investigation was the connection between Tammy and Alex. Vince said that Chad was the connection.

Blake had no further questions.

Prior was up for a limited re-cross. Prior said if someone was trying to hurt someone at close range, they would use a pistol or shotgun. Vince said that rifles could be used at close range.

Prior said the fact that Alex had looked into shooting through the Dodge Dakota showed his target was likely someone in the Daybell family. Vince agreed.

Prior had no further questions.


The court took a break. When they came back Sugar-Salem School District technology director Spencer Cook was next on the stand. He is in charge of all electronics for the district including emails.

Wixom asked Cook if he recalled receiving requests from police to retrieve an email from Charles Vallow to Tammy Daybell. He said yes. Wixom asked Cook to read a portion of the email.

"Tammy, my name is Charles Vallow. I have some vital and disturbing information regarding your husband and my wife, Lori. This is your work email, so I will have to wait and send you the evidence that is very disturbing."

Cook testified that he found the email in Tammy's deleted folder and that Charles' email had been put into the blocked category in Google. Cook said so any future emails from Charles would have been blocked.

Wixom had no further questions and Prior declined to cross.

Chad Daybell Trial: Freemont County coroner Brenda Dye and Detective Bruce Mattingly take the stand.

On the 10th day of trial, the Freemont County coroner Brenda Dye was first on the stand. She was elected as coroner in 2019. She is also an EMT. 

Dye testified that she responds to unattended deaths, determines cause of death and signs off on death certificates. She said that when she responds to an unattended death, she looks for weapons, medications and the health history.

Wixom asked Dye to explain what the term "Lividity" meant. She said that it is the lowest point of the body that the blood pools when somebody is no longer living. She said that it looks like a bruise.

Wixom asked Dye how identifying whether or not there's lividity helps her in her role as a coroner. She said that it helps her know how the body was found and the position of the body at the time of death. It helps her to know if the body was moved.

Wixom then asked her to explain the term "Riga Mortis." She said that it is the stiffening of the body and occurs two to six hours after death and releases after 8 hours of death. She said that it helps determine time of death. Dye said that the temperature can be taken to determine time of death and that the abdomen is the last place that warmth leaves the body. She said that if the abdomen is cold, then the person has been dead for quite some time.

Wixom asked Dye if she remembered responded to Tammy's unattended death. She said yes. 

Dye then testified that prior she had never heard of Tammy or Chad, and she didn't know any of the Daybell family. 

Dye said that she had received the call early in the morning on October 9th, 2019. She said that she was on a call in the ambulance, so it took her 45 minutes to get to Chad's house. She said that after she got the call, she called her deputy coroner to start the investigation because she only lived 10 minutes away.

She said when she arrived on scene, she noticed Chad was distraught and upset walking around. She said that Garth was with Chad, and he seemed emotionless.

Dye said that after she looked at Tammy's body, she questioned Chad about her past health history.

Dye then described what she noticed when she saw Tammy's body. She said that she saw blood-tinged sputum (pink foam) coming from her mouth. Tammy was wrapped in a blanket. 

Dye said that she asked if that was the position she was found, and Chad had told her no, that was hanging off of the bed with her face and head towards the floor on her left side. When Chad discovered Tammy was deceased, he had called for Garth, and they picked her up off of the floor, put her back in bed and covered her with a blanket.

Dye said she looked at Tammy's body to see if there was bruising and any signs of a struggle. She saw rigor mortis had set in. There was lividity on her back and the back of her legs which indicated that Tammy died on her back. Tammy was cold to the touch. Dye said that there was also a kitchen towel to the side of the bed, and it had blood tinge sputum on it. Dye said that Chad told her that he had used that towel to wipe Tammy's face.

Dye testified that Chad said that he felt Tammy's body roll off the bed, and that’s what woke him up. Dye said she asked him how that was possible because she was really cold. Chad had told he that he thought it was because he pulled on the sheets. He had told Dye that Tammy was going through menopause, and she would have hot flashes and she liked to sleep with her feet out of the covers and on the edge of the bed.

Wixom asked Dye if at the time did Chad pulling on the sheets make sense for Tammy to fall out of the bed. Dye said at the time yes, but looking back on it, it does not make sense. She said that it would take a lot of force to roll a body out of bed.

Dye testified that Chad had told her that Tammy had been feeling really off for the past few months. That she felt outside of her body, not normal. That she had been having fainting spells and one occasion they were at the alter at the temple, and Tammy fainted. He told Dye that Tammy had low blood pressure but didn’t seek medical attention because she didn’t like going to the doctor and she treated everything naturally. Dye said that there was a lot of natural supplements and oils in the kitchen cupboards and a natural remedy book on the table by her side of the bed.

Dye testified that Chad had told her that it was about 12:30am when Tammy had her coughing fit and around 6am when he woke up from her falling out of bed.

Dye testified that it had been her first year in office and she had attended under 10 unattended deaths. She also had no medical training at the time. She said that now she responds to 20 to 50 a year.

Dye said that she initially determined Tammy's cause of death to be pulmonary edema into a cardiac event. She said that pulmonary edema is the back up of fluid, blood in the lungs. Dye said that she helped arrive at the cause of death due to the fact that Chad had told her that Tammy had low blood pressure and seizures.

Dye testified that she had made amendments to Tammy's death certificate. The manner of death was changed to homicide and the cause of death was changed to asphyxiation by suffocation. She explained that she made that change because Tammy's body was exhumed and a medical examiner from Utah autopsied her body.

Dye testified that she attended the autopsy and explained what was found. "As they were dissecting the bruise, there was a very deep bruise on her arm. It didn’t make sense that she had thrown up the night before because she had stomach contents." Dye said that "Her stomach was full of food. If she threw up, there wouldn’t be food in her stomach during the autopsy." 

Dye said that all of Tammy's organs were healthy except for the lungs so she couldn't have had seizures. When they dissected the lungs, there was a lot of foam and there shouldn't have been the foam in the lungs after two months.

Dye said that she received a call from the Arizona police who wanted her coroner records because there was a death in Arizona and Chad’s, Alex's and Lori's name were brought up and there was also the attempted murder of Brandon. She said that later JJ and Tylee's names were brought up as well. All of this helped her change the death certificate.

Wixom asked Dye if she had any regrets about her original decision. She said she did. "Had I known that information, I would have ordered an autopsy. At that time, with my limited training and being new, I did the best I could with the training I had at that time."

Wixom was done with his questioning.

Prior was up for the cross. He said that there were no fresh bruises on Tammy anywhere. Dye said yes there was on her arm. Prior said that Dye used the words "old bruises" in her report. Dye said yes.

Prior said that Emma didn’t want an autopsy done because she didn’t want her mother to be treated that way. Dye said yes.

The court took a break. When they were back Prior entered an exhibit which was a body chart. Dye testified that according to the chart Lividity was found on Tammy’s entire body. Also written on the chart was "Blood-tinged foam" and "old bruising". Prior said to Dye "You didn’t put ‘new bruising’ did you?" Dye said no.

Prior admitted a photo of Tammy’s right arm that was described as showing some discoloration. Prior asked Dye if the old bruises that she was talking about were reflected in the two dark colored marks on Tammy's arm. Dye said yes.

Prior asked Dye if she asked Garth about him buying Tammy a Quarter Pounder and French fries. Dye said no. Prior asked her if she saw potatoes in Tammy's stomach. She said no that she did not identify what was in Tammy's stomach only that there were contents in her stomach. Prior said, “We don’t know if Tammy threw up or not before she died right? Other than what Chad told you?” Dye said yes.

Dye confirmed that Prozac, acetaminophen, ibuprofen and vitality extracts were in the kitchen cupboard.

Prior asked Dye if she was told that Tammy would have minor fits consistent with seizures. Dye said yes.

Prior said that Emma talked about how Tammy was taking clogging classes but couldn’t keep up. Dye said yes. Prior said that Chad said that Tammy had fainted in the temple. Dye said yes.  Prior said that Dye had made a determination that there was a medical reason as to how Tammy passed away, but it all changed. Dye said yes.

Dye confirmed that she worked with the FBI and helped to get the order to exhume Tammy's body.

Prior asked Dye that at the time they were digging up Tammy, were they looking for something. Dye said suspicious activity and anything that resulted in homicide.

Dye confirmed that Tammy's autopsy was performed in Utah.

Prior had no further questions.

Wixom was back for the re-cross. Dye testified that she had asked about Tammy's medical history, looked for medications and looked for anything that might have been suspicious. She also worked with the detective and instructed her on what pictures to take.

Dye testified that she mostly talked to Chad and Emma on the scene and that Garth would mainly nod to questions. Wixom asked Dye who was the person on scene that gave her the information she was relying on. Dye said Chad.

Wixom asked if there had been a way to verify how long those supplements had been sitting on scene for. Dye said no. Wixom asked if it could have been possible for someone to put those supplements on scene before she arrived. She said yes.

Dye testified the reason why she filed the amended death certificate was because of the results of the autopsy and two dead children, JJ and Tylee, at the residence.

Wixom asked Dye if she had the qualification to tell how old the bruising was. She said that they looked old, but she didn't have the expertise.

Dye testified that Garth had told her that he was sharing his Duloxetine prescription with Tammy.

Kelsie Harris was next to take the stand.

Wixom had no further questions.

The next witness called to the stand was Kelsie Harris. In 2019 Tammy had been a student in her clogging class and Tammy was a librarian at a school that Kelsie also worked at. She said that she would see Tammy every day and that they were friends.

Harris explained that clogging was a fast-paced style of dance, and you wear shoes that were similar to tap shoes.

Harris testified that Tammy came to her class in early August of 2019 until her death in October. She said that the class was every week once a week and it was 60 minutes and Tammy attended every class. Harris couldn't recall any issues with Tammy getting tired or falling behind in class.

Harris said that she went to a high fitness class in St. Anthony, and she stood by Tammy in that class. Harris explained that the class was high-intensity and it consisted of burpees, jumping jacks and explosive movements. She said that the class was held two times a week for 60 minutes. She said that her and Tammy attended the classes in late September of 2019. Harris said that Tammy kept up in class and was did the high intensity moves. She testified that she never noticed anything that would have given her concerns about Tammy's health.

Prior was up for the cross. He asked Harris if Tammy had the body of someone extremely fit. Harris said that Tammy was a very fit woman.

Harris confirmed that she saw Emma Daybell in the high-intensity class with Tammy and also in the clogging class she taught.

Shanna Miller was next up to testify. Miller was a schoolteacher at Central Elementary in Sugar City for over 30 years and worked with Tammy. Miller was on the committee to interview Tammy for a position at the school. Tammy was hired as the computer specialist and librarian. 

Miller also attended the high-fitness class with Tammy and Emma twice a week. She said that Tammy started the class in the spring of 2018 and attended until her death. Miller said at first Tammy and Emma could not complete the workouts correctly but over time they did well.

Miller testified that she would see Tammy every day at work, sometimes several times a day.

Miller said, “I would say from the time she started the fitness class, the confidence level and her overall image of herself had improved. It looked like she was in great health to me.”  

Miller testified that she was in complete shock when she learned about Tammy's death. Miller said that hours before that, she had seen her at work, and Tammy was happy, healthy and conversing with the kids at work all with a smile.

Miller believes Tammy Daybell started working at the school in Sugar City in 2018.

Miller said Tammy was attending the high-intensity classes for at least a year and a half because she was getting ready for a 5k.

Miller testified that she believed Tammy was very fit and had the stamina to complete workouts.

Next up on the stand was Jennifer Geisler. Geisler works at Central Elementary school as a First-grade teacher. She has worked there for 26 years. She worked with Tammy in 2019.  She said that Tammy was the librarian, and she would see her every day.

Geisler said that her and Tammy were good friends, and that Tammy was always bubbly and happy. She said that Tammy was a person that you wanted to be around. Geisler was the one who invited Tammy and Emma to a high-fitness class.

Geisler said that Emma and Tammy were always giggling and adding their own moves. Geisler said that Tammy loved the class and kept up. She couldn't recall Tammy taking breaks.

Geisler testified that Friday before Tammy died, she ate lunch with her. She said that Tammy was healthy, happy and talkative. Geisler said that Tammy was sitting by her son Seth just like any normal day. 

Geisler said that she was super surprised that Tammy passed away due to her being super healthy.

Wixom had no further questions.

Prior was up for the cross. Geisler said that her and Tammy were good school friends, but she never went to Tammy’s home.

Wixom was up for the re-cross. Geisler testified that High fit was more intense, and Zumba was a little more "dancey".

Wixom asked Geisler if she witnessed Tammy's eating habits. Geisler said yes, she said that when she'd follow Tammy through the lunch line, she'd make comments that Tammy took all the vegetables. Geisler said that Tammy ate super healthy, and she wish she had ate as healthy as Tammy did.

Wixom had no further questions.

Prior was up again with more questions. Geisler testified that Tammy and Enna did the high fit class and not Zumba.

The court took a recess, when they came back Detective Bruce Mattingly was next to testify. Mattingly has worked for the Freemont County Sheriff's office for 23 years. For the last 7 years he has held the title Detective Sargant.

Mattingly testified that Greenhalgh had called him on October 9th, 2019, about Tammy's unattended death because she couldn't get a hold of the detective that was on call.  He then explained that an unattended death was any death whether it is natural, self-inflicted or otherwise accidental that is not being attended to by the physician.

Blake asked Mattingly if before he received the call from Greenhalgh, had he heard of Tammy or Chad. He said no. 

Mattingly said that he had asked Greenhalgh to describe the scene to him and the state of Tammy and who found her and who else was on scene. Blake asked Mattingly if at the time had Greenhalgh reported anything suspicious to him. He said no. Mattingly testified that he told Greenhalgh, "To take a shit ton of photos." He said that he also told her to talk with the coroner when they got there and find out if there was going to be an autopsy and if blood needed to be collected. 

Blake asked Mattingly if at the time did Greenhalgh mention the pink foam or sputum coming out of Tammy's mouth. Mattingly said that no she did not. Mattingly testified that he has attended 80 or more unattended deaths. He said that he had never seen sputum at any unattended death. Mattingly testified that he would have responded if he'd known that sputum was involved.

Mattingly testified that he had called Lt. Powell and gave him an update as to the call that Greenhalgh was on.

Mattingly testified that detective Kakumanu was the detective on call.

Mattingly confirmed that at the time there was not an investigation into Tammy's death.

Blake asked Mattingly when an investigation into Tammy's death occurred. He said in late 2019. Mattingly testified that he learned that Rexburg Police Department and FBI were looking for JJ and Tylee and in Arizona, they were investigating the attempted shooting of Brandon and Charles' death. Mattingly testified that in addition to Tammy and Chad, he never heard of JJ, Tylee, Charle, Alex or Lori at the time of Tammy's death.

Blake asked Mattingly if during the investigation had he looked into Tammy's health. He said he did, he said that he looked at her medical records. She asked if there was any indication of health issues. Mattingly said that there were general health issues. He said that Tammy had been prescribed medication for wrist pain and medication for managing depression.

Blake asked Mattingly if he was able to review statements made by Chad to the coroner about Tammy's health. Mattingly said yes, Chad reported that Tammy as being dizzy, fainting and slowing down. Blake asked Mattingly if when he looked at Tammy's medical records, did he see any reference to Tammy being dizzy or having seizures. low blood pressure or any explanation for any slowed down activity. He said he did not. 

Blake asked Mattingly if he was able to review Greenhalgh's reports. He said yes. Blake asked him if there was any indication in the reports that Garth had concerns about Tammy's health. Mattingly said no. Blake asked if Chad had reported any anemia or had been concerned because of history of heart conditions in the family. Mattingly said none. Mattingly testified that Emma had reported that Tammy had slowed down in one of their fitness classes. Blake asked Mattingly if he ever got to talk to Emma. He said he did not and that he reached out to her several times, but she wouldn't talk to him.

Blake asked Mattingly if through his investigation had he learned if Tammy had an life insurance policy. He said yes, he learned that Tammy had two life insurance policies.

Blake a displayed a life insurance policy that was filled out by Chad Daybell. He signed it on October 30th, 2019. He had written that Tammy became impaired on October 18, the before she died. He also had written that Tammy didn't have a physician. 

Blake asked Mattingly if what Chad wrote on the policy matched the statements that he had given to law enforcement. Mattingly said no.

Mattingly testified that he got a search warrant for Fitbit. At the crime scene Tammy had a fit bit on a table on her side of the bed and well as on her wrist in Facebook photos. Mattingly said that he looked for heart rate, sleep patterns, and her activity.

Blake admitted and then displayed the Fitbit information.

Mattingly testified that they confirmed that the Fitbit information they recovered was indeed Tammy. The account had her email, birthday and family members added to it. He said that the last sync date was the day after Tammy died. Mattingly confirmed that the Fitbit was never found. 

Mattingly testified that they weren't able to get Tammy's heart rate information from her Fitbit account. He also said that the sleep data was very sparse leading him to believe that Tammy didn't wear her Fitbit when she slept. Mattingly testified that they were provided Tammy's step counts from day to day and year to year. Mattingly testified that from January until Tammy's death, she was doing the 10,000 steps a day and was above average. He testified that there was nothing to show that she severely slowed down. He confirmed that the month that Tammy died, she was on track to be above average.

Blake asked Mattingly if he had interviewed Tammy's family and friends. He said yes. Blake asked if any of the information he gathered in the interviews supported what Chad had said about Tammy's health. Blake asked Mattingly what he had learned about Tammy's health through the interviews.  Mattingly said that he found out that Tammy was very active and had been described as a "go getter" and that there was no indication that she was slowing down, had seizures, fainting spells or low blood pressure.

Blake admitted and then displayed the second life insurance policy.

Mattingly testified that Tammy's Primerica life insurance there was $300,000 and on her LifeMap there was $130,000. He said that he learned that they both had been paid out to Chad.

Prior was up for the cross. He asked Mattingly what were the times that he tried to talk Emma. Mattingly said he didn't know. He testified that he was never assigned to talk to Garth and so he didn't. Mattingly testified that he had tried to talk to Joe Murray, Emma's husband, but he refused to talk too.

Prior asked Mattingly if in reviewing Tammy's medical records if he saw that she suffered from anemia. Mattingly said that was listed as past issue.

Prior told Mattingly "We don't know who wore the Fitbit." Mattingly agreed. Prior stated that Tammy had a Fitbit competition with her family. Mattingly testified that he learned that Tammy was a competitive person.

Prior had no further questions.

Blake was up for the re-cross. Blake asked Mattingly if any of Chad’s children voluntarily come forward with information. Mattingly said not one. Emma refused to speak to Mattingly and did not provide any information on Tammy's health.

Mattingly testified that besides her sparse medical records, Tammy's medical information came from her family.

Blake displayed Tammy's life insurance form again that Chad filled out. Blake pointed out that Chad put that Tammy's health problems started the day before she passed.

Blake had no further questions.

Next up to the stand was Detective Vince Kaaiakamanu. He currently is the Chief Deputy for the Madison County Sheriff's office. He had previously worked for the Fremont County Sheriff’s Office.

Vince testified that he originally had missed Officer Greenhalgh call when she had responded to the unattended death of Tammy because he had been helping Idaho Falls Police Department with an officer-involved shooting. He said that he ended up talking to Greenhalgh and learned that there was nothing suspicious, so he decided that he wasn't needed at the scene. 

Vince testified that no investigation was opened at that time after the unattended death. 

Vince testified that an investigation was later opened for Tammy. Vince said he became involved in Tammy’s case around March of 2020. He said that Freemont County became involved on October 31st, 2019, when Arizona PD called them and asked them for assistance. Blake asked Vince when he became involved what other investigations were pending. He said the homicide of Charles, the search for JJ and Tylee and the attempted shooting of Brandon.

Vince testified that his main focus was Tammy, but he did assist with locating and helping with JJ and Tylee too. 

Vince confirmed that he reviewed the attempted shooting of Tammy on Oct. 9, 2019.  He said that the nature of the call had to do with a suspicious event. He confirmed that it involved a gun or paintball gun being pointed at someone.

The 9-1-1 call made by Tammy's son-in-law and the call to dispatch that Tammy made were played for the court again.

Blake asked Vince how Tammy first referred to the weapon in the call. He said that she first called it a paintball gun and then she also described it as a gun and a riffle.

Blake asked Vince he if was aware of a search that was done on an apartment that belonged to Alex. He said yes. Blake then asked him if he was aware of some firearms that had been recovered as a part of that search. He said yes. He had seized them for evidence. Blake then admitted into evidence one of the photos that Vince had taken of one of the firearms that had been seized. Vince testified that he thought it could have been what was used during the paintball incident. Blake asked Vince if the firearm looked like a rifle. He said it was.

Blake asked Vince if he had experience with paintball guns. He said yes, that growing up he had shot paintball guns all the time. He also said that being in law enforcement and on the SWAT team, they utilized paintball guns and paintball riffles that were set up similar to AR-15's for their training. Blake also asked Vince what his experience with assault rifles was. He said that it was the same as his experience with paintball guns.

Blake asked Vince if there were some paintball guns to look like rifles. He said yes.

Blake asked Vince if he remembered looking at some searches done on a Homer J. Maximus account. He said yes and testified that the account was associated with Alex. Blake admitted an exhibit that Vince created from reviewing those searches.

Chad Daybell Trial: David Warwick Finishes His Testimony and Lori's Niece's Ex, Brandon Boudreaux, Takes the Stand.

 
Prior continued his cross of David Warwick. He asked about Warwick's previous testimony and communication with prosecutors. Warwick confirmed that reviewed a written document from the prosecutors. He also confirmed that he described Chad as kind, meek, humble and religious. 

Prior asked Warwick if it would be fair to say that he may not agree with all of Chad's religious beliefs and Chad may not agree with his. Warwick said yes.

Prior asked Warwick if he knew what a seance was. He said yes. Prior asked if Warwick and or Gibb ever took part in one. Warwick said no.

Warwick testified that he and Gibb have lived separately for two years. Prior asked Warwick how long that had lived together. Warwick said several months. Prior asked Warwick if the reason why he married Gibb is so they wouldn't have to testify against each other. Warwick said no.

Prior asked Warwick if he saw Chad on Saturday, the weekend he was at Lori's. He said yes early in the afternoon. Prior said that after Warwick had a late breakfast he had went to the Firm Foundation. Warwick said yes.

Prior asked Warwick if he saw Chad on Sunday. Warwick said yes, he saw Chad at the park late in the morning. Prior then asked Warwick if he remembered meeting at the 80-acre land with Alex and Gibb. Warwick confirmed that JJ wasn't there.

Prior asked Warwick how long did he meet with Chad on Saturday. He said a half an hour.

Warwick confirmed that Chad showed up with the realtor on Saturday in church clothes. Prior said that he didn't understand how Chad could have meet Warwick if he was at church. Warwick told Prior that they were attending their “calling,” not church services.

Warwick confirmed that he did not see Chad on Friday.

Wixom was up for the redirect. Warwick testified that the last time he talked to prosecutors about his testimony was a few months ago.

Warwick testified that he had told law enforcement that he liked Chad. Wixom asked Warwick if he used a more descriptive language when he discussed Chad. He said he could not recall and reviewed a report from Det. Hermosillo for reference. After Warwick reviewed the report, Warwick said he was angry Chad told Gibb not to speak with police. “When someone makes a call like that, something’s wrong” he said. Warwick also said that Chad was manipulative and developed people’s confidence in him to his favor.

Warwick was asked why he married Gibb. He said that he married her because she was a wonderful woman who was great with his son with Down syndrome.

Warwick testified that the weekend he was at Lori's, Chad said that Tammy was healthy. He also told Warwick that he had a dream that Tammy would die.

Wixom asked Warwick if his visions ever led him to believe that he had superpowers. He said no.

Prior now for the re-cross. Warwick testified that Chad told him that weekend that Tammy would die sometime in the near future. He also confirmed that he heard had Chad had discussed Tammy dying before met Lori.

Brandon Boudreaux, Melani P’s ex-husband was next to be called to the stand. Melani is Lori’s niece. Brandon and Melani were married for about 10 years from 2008 and they have four children together.

Brandon testified that he had met Melani's family. He said he met Janice and Barry Cox, Adam Cox, Alex Cox, Summer Shiftlet and Lori Daybell.

Brandon testified that he would spend holidays with the Cox family. He said when they lived close, they see each other once a month. He said they also went to trips together. Brandon said that he would spend a lot of time with Lori and Charles Vallow and got to know them very well. He said that his kids would play with JJ and Tylee.

Wood asked Brandon if he was aware that JJ had some special needs. Brandon said yes, everyone could tell JJ had autism. He said that early on JJ was nonverbal and that he had a lot of energy and didn't know how to use it. As JJ got older, he began to talk and would rephrase things over and over.

Brandon said that Tylee was a normal teenager. He said that she had her moments where she'd want to sleep in late and would want no one to bug her and watch too much Netflix. He said that other times she'd open up, was sweet and had good motherly instinct. She would often babysit Brandon's kids. Brandon said that Tylee was very protective of JJ. Brandon confirmed that he had a special religious connect to Tylee, he baptized her.

Wood asked Brandon about Melani P's relationship with Lori. Brandon said that Melani's mom died when she was young, and she had an awesome stepmom, but she also looked a lot to Lori as a mother figure. He said that Melani was easily influenced by Lori, spent a lot of time with her, wanted to be like her and spent a lot of time looking for her acceptance.

Brandon said that he had a really good relationship with Charles. He said that they had similar personalities and loved what they did for work. He said that Charles had the mentality of a producer. He said that they both loved their faith and spent a lot of time talking about how grateful they were for their families.

Wood asked Brandon if he recalled the last Christmas that his family spent with Lori and Charles' family. He said it was in 2018 and it was different from the other Christmases they spent together. He said they went to Lori's house and "you could just feel the difference". He said that that Christmas Gibb was there, and it was weird having a stranger at Christmas. He said that there was a lot less conversation from Lori to Brandon and lot less attention shown to his kids. He said that Lori used to dote on his kids and make them feel loved. He said that Christmas she didn't. Brandon said he told his wife, Melani, after he left the party that it felt different. She told him that it didn't feel different at all.

Brandon said that Melani didn't use to like to go to church, that he was the advocate for going, but all of that changed in the fall of 2018 she started going to the temple daily. He said that the temple is very important in the LDS faith, but normally the goal is to go once a month. He said he believed in moderation and that going to the temple for anybody was a lot, especially a mother with kids and home and other responsibilities. He said it was surprising.

Wood asked Brandon if going to church was the same thing as going to temple. He said no. He said you go one time for yourself to make a promise to God. He said it was like being baptized. Brandon said that each time you go afterwards you go for someone who has passed on. Church is someone they would go to every Sunday in a church building for church services.

Brandon said that in 2018 Melani started going to things that she said were "Firesides", but he said that he wouldn't call them firesides. Wood asked Brandon to explain what "Firesides" are. Brandon said that in his faith there are groups of people that live in the same geographical area called a "ward" and for each ward there is a leader called a "bishop". The bishop, counselor or leadership group would set up meetings, besides Sunday church service, that would lift them up or encourage them spiritually. He said that they are usually outside the normal times you go to church, and they are usually in the evening.

Brandon said that Melani was just going to people's houses where there'd be meeting not under direction from the church, and often they would talk about things that weren't normally talked about in church. Brandon said that one time she came home and wanted to go buy $10,000 with of food storage all at once because she was afraid of the end of the world.

Brandon said that he tried to share his perspective with Melani. He said he had served a mission and he saw some people who fell away from the religion because they weren't focused on the core of the faith, and they got lost.

Brandon said that he asked if he could join a fireside, but Melani told him that he wasn't welcome.

Brandon said that Lori was the one who invited Melani to the firesides.

Brandon testified that in the beginning of 2019, Lori sent a letter that claimed Charles had been cheating on her, so she took all of his money out of his bank account, changed the locks on his house and stole his truck. Brandon said that it was very irrational to him. He didn't even know about it for a while. He said that he hadn't heard from Charles in a while and found out that Melani blocked him in his phone.

Brandon said that Charles didn't want the breakup to happen, he tried not to let it happen and was sending group emails to try to work through it.

Brandon said that Lori left JJ with Charles. He said that JJ had to be watched all the time, he couldn't be left alone. He said you had to make plans around watching JJ.

Wood asked Brandon of Melani took a side. Brandon said he try to encourage Melani not to pick a side, just to love them both and to make sure that the kids had a safe place to stay. He said that Melani told him that she felt uncomfortable around Charles. Brandon said he did his best to honor what Melani wanted.

Wood asked Brandon if he saw Lori in early 2019. He said not at all. Wood then asked him if he'd seen Charles during that time. Brandon said that he did a few times. JJ would come over and play with his kids. Wood asked Brandon what JJ would do when he came over. Brandon held back tears as he talked about how JJ would play with his kids and would play video games. He said that JJ would kind of bounce all over the place and his son would keep an eye on him and play with him.

Brandon said while JJ was playing with his kids, he would talk to Charles. Brandon said that Charles was pretty distraught, sad and overwhelmed.

Wood asked Brandon if he was aware if there was an attempt with reconciliation between Charles and Lori. Brandon said yes, Charles tried to reconcile and stopped the divorce. He said that Charles said that he would always try to make it work.

Wood asked Brandon if he took a trip to his in-law's house in the summer of 2019. He said that he did in June for his wife's younger sister's wedding. Wood asked Brandon if anything out of the ordinary happen. Brandon said first his grandfather died of a heart attack. Brandon said that he told Melani when the funeral was, and she said she didn't want to go. Brandon testified that this led to an argument because he wanted him family to go with him to the funeral.

Brandon testified that the argument led to something that didn't make any sense to him, Melani accused Brandon of hacking into Lori’s computer.  He said that Melani also accused him of being gay.  Brandon said he was heartbroken. He said that the argument went from the afternoon through midnight. After Melani went to bed he said he stayed up “troubled” all night. He said texted Lori and Charles, telling them if his family was “ruined” it was “on them.”

Wood asked Brandon if Lori ever responded. He said no, but Charles responded the following evening. He said that he and Charles spoke, and Brandon apologized to Charles for not being there for him. He said he felt like he believed Charles felt going through a separation and divorce. Brandon said that Charles was really gracious and that was the last time he talked to him.

Brandon said he no longer had any contact with Lori, JJ and Tylee. He and Melani were divorced, and the process began immediately after his grandfather’s funeral.

Brandon said he sold his house, helped Melani get a rental home and he got a rental home for himself. He said that his rental home was close to Melani's because he wanted to make sure his kids had stability.

Brandon said that since June, Melani and stopped talking to him, they would barely text and there was no "connection" anymore. He said that she was very "cold" to him.

Wood asked Brandon if at that point, did he know where Lori was. He said no.

Brandon described what happened on October 2nd of 2019, the day that someone tried to shoot and kill him. He said that he got his kids ready for school, dropped the older ones off to school and the younger one to Melani's house. He said that he then went to the gym. When he returned from the gym, he saw a Jeep parked on the corner near his home that he thought was “awkward” and out of place. He said that the Jeep had a Texas license plate and no spare tire on the back of the Jeep. He said that the window of the Jeep opened up and he saw a gun and then a silencer, and his window shattered with a bang. Rather than turning into his driveway, he floored it to the end of his street and parked near a community pool, where he called 9-1-1. He said he then saw the Jeep come around the corner, do a U-turn and then go the other way. He said that he followed it at first, but the 9-1-1 operator told him to go and park in front of his house and wait for police, who came shortly after.

Brandon confirmed that he only moved into the house a few days before he was shot at and the only ones who knew he had moved was Melani and his neighbors.

Brandon said that it was the driver's side window that shattered, and he found out later that the bullet was lodged in the door frame. He said that the bullet hit right above where is had was.

Brandon said that after talking to law enforcement and Zac Cox and others, he was confident that the Jeep was Tylee's. He said that Charles got the Jeep for Tylee in 2019.

Brandon said that Zac was Adam's son and stayed with Lori and Charles for a period of time.

Brandon said that at the time of the incident he was an insurance agent and Charles had previously given Brandon all the insurance information for the Jeep, so he relayed that to law enforcement including the VIN.

The court took a break and when they returned Wood published photo of Tylee’s Jeep. Brandon confirmed that was the Jeep he saw on October 2nd.

Brandon said that entire situation was traumatic, and he knew a resolution wouldn’t come quick, so he decided to help police in any way possible. He hired a private investigator and provided police with emails he received from Charles which voiced concerns Charles had about Lori’s mental health and the belief set she was building. Brandon said that Charles had sent those emails to Lori's whole family. 

Brandon said a lot of the emails had things that showed what Chad had sent to Lori about the light and dark scales and that is how Brandon learned he was considered a dark spirit.

Brandon said that he wanted to learn more, so he Googled "Chad Daybell." He said that when he typed Chad's name in Tammy's obituary popped up. He said that something inside him was shocked and so he called and texted the detective on his case at the time and told him what he found. Around that time Brandon learned that JJ and Tylee were missing.

On June 9th, 2020, Brandon said he received a call from Rexburg while he was at his parents' house informing him that they had found JJ and Tylee's bodies. He said that the next day was his wedding, so he got remarried and shortly after that he drove up to Rexburg. When he got to Rexburg, they asked him to identify JJ. Brandon, weeping on the stand, stated that he identified JJ by photos of his deceased body on June 11.

Wood had no further questions.

Prior began the cross. He asked Brandon how often he got to see Charles. Brandon said that when he lived close, he'd see Charles every week and when Charles would travel for work sometimes, he wouldn't see him for a whole month.

Prior asked Brandon when it was that he first me Lori. He said it was in 2008.

Prior asked if Brandon agreed with him that Lori and Alex had a very close relationship. Brandon said it was off again on again. He said that sometimes they were very close and other times they wouldn't see each other very often. He said that it seemed that they knew each other very well.

Prior asked Brandon if he noticed that every time Lori would move Alex would follow. Brandon said not always, but sometimes that would happen. He said that there was a time where Alex lived with him and his family while Lori was living in Hawaii for a couple of years.

Prior asked Brandon if when Lori left JJ and went to Hawaii, did he know where Lori was. He said at the time he had no idea where she was.

Brandon agreed that JJ and Tylee had a close relationship. Prior asked him if it was true that Tylee was a second mother figure to JJ. Brandon said at times, but she was a teenager so there were times that that wasn't the case. He said that in the emails Charles had sent, he said that JJ would often say how he missed Lori.

Brandon confirmed that Charles had attempted a reconciliation with Lori. Prior asked Brandon if Charles had discussed with him Lori trying to convince him into her being the beneficiary to his life insurance policy. Brandon said that Charles never talked to him about his life insurance policy.

Brandon confirmed that he thought it was odd that Gibb was at Lori's in 2018 for Christmas. He confirmed that it seemed Lori and Gibb had a close bond. Prior asked Brandon if he knew when it was Lori and Gibb first met. He said no.

Prior asked Brandon if Melani participated in the gatherings in August, September and October of 2018. Brandon said he believed so. Prior tried to suggest to Brandon that Gibb was the one who planned and organized the gatherings. Brandon said he couldn't testify to that he didn't know who planned them.

Prior asked Brandon if David Warwick was at the Christmas gathering with Gibb. Brandon said no.

Prior said he was confused about why people in Brandon's faith go to the temp and suggested that they only went to get sealed when they first got married. Brandon said there are many things that can be done at the temple such as baptisms for the dead. Prior cut Brandon off before he could explain the other things that could be done at the temple.

Brandon testified that you could get sealed to your spouse for all of time and eternity. Prior asked him if regardless of what happened would you be sealed to your spouse. Brandon said not necessarily. He said if you break your promises to God you no longer will be sealed.

Prior asked Brandon if he ever heard of the group "Preparing the People." Brandon said yes. He said he had never been to an event so he couldn't testify to what they were about.

Prior asked Brandon if he had heard of anyone who had visions. Brandon testified that he never had visions and didn't personally know of anyone who has had them.

Prior asked Brandon if Melani had been involved in seances. He said he had no idea.

Brandon testified that he had never experienced light and dark teachings in the LDS faith.

Prior had no further questions.

Officer Ryan Pillar was next to take the stand. He had worked for the Gilbert police department in Arizona for over 17. He said he was a patrol officer for nine years before moving to the special victims' unit in 2016 and then to the Violent Crimes unit in 2019. He said he was now voluntarily back on patrol as working with the schools.

Pilar he was the lead detective in the Brandon Boudreaux shooting incident. He said that the call came in at 9:14 am. Pilar said that there were shards of glass and Brandon's vehicle was parked in front of the house. He said that the vehicle had evidence that it had been hit by a projectile. He said that witnesses confirmed that there had been a vehicle idling in front of Brandon's house at the time of the shooting.

Deputy Idaho State Attorney General Ingrd Batey asked if he received a description of the vehicle. Pilar said yes, that after talking to the witnesses and Brandon he was able to ascertain that it was a darker gray Jeep displaying a Texas license plate, without a spare tire attached to the rear hatch. 

Pilar testified that at the time he learned of a recent homicide in Chandler in which Brandon's wife Melani's family had been present. Pilar said that he had learned that Brandon was going through a divorce at the time.

Pilar testified that the Chandler investigation learned that Charles Vallow was the victim of the homicide and that his wife Lori was Melani's aunt and at the scene was Lori's brother Alex Cox.

Pilar said that at the scene where Charles died was the gray Jeep they had been looking for and it was registered to Charles.

Batey asked if Pilar developed a person of interest during his investigation into Brandon's shooting. He said yes, Alex. 

Pilar said that they were able to use an LPR to track the Jeep's movements from Rexburg to Gilbert and back around the time of the shooting.

Pilar said that once the Jeep was located, he reached out to Rexburg and Freemont County Sheriff’s Office, and they served a search warrant in November to Lori's apartment. While searching the Jeep, Pillar and other officers collected physical evidence, including DNA swabs and gunshot residue.

Batey asked Pilar if at some point in the investigation did the direction of the investigation shift. He said yes, it shifted on November 26th to a missing persons' case after learning that Lori's children hadn't been seen for sometimes.

Pilar said that they began interviewing family members and associates as well as setting up surveillance cameras of the family members and acquaintances that were believed to have the kids. Pilar said that there was no indication that the kids had been in Arizona at that time.

Pilar testified that he stopped his surveillance of Alex when he died on Dec. 12, 2019. They then executed a search warrant of his home and found guns, clothing and literature authored by Chad. Also, inside Alex's truck they found gun paraphernalia.

Batey had no further questions.

Prior was up for the cross. He asked if the common denominator of the instances was Lori and Alex. Pillar agreed.

Prior had no further questions.

Next witness to be called was Deputy Colter Cannon. He is with the Fremont County Sheriff’s Office, is a school resource officer and patrol deputy. He has worked for the Sheriff's office for 10 years. 

Cannon was on patrol when he received a call reporting a “suspicious circumstance” involving Tammy Daybell and that someone had pointed a gun or a paintball gun at her. 

The 9-1-1 call from Tammy's son-in-law, Joe Murray was played. The phone call was choppy and hard to hear in parts.

9-1-1- "9-1-1 what's your emergency?"

Murray- "Yes, so my mother-in-law who is what had just gotten home about 10 minutes ago was unloading her car and she thinks the man but she's not 100 percent sure because she couldn't see because he was wearing a ski mask came up to her with a paint ball gun and started shooting at her, but it wasn't loaded. You know nothing came out of it." He also said something about that he ran around back.

9-1-1-: "What's the address? Are you there? Hello, are you still there?

Murray: "Yeah can you hear me?"

9-1-1: "OK, now I can hear you. What's the address?"

Murray then gave his address.

9-1-1: "OK, I need her address. What's her location?"

Murray: "I think it's 201."

9-1-1: "Her address 201 N 1900 E?"

Murray: "Yep, yep."

9-1-1: " And does she know which direction he ended up running?"

Murray: "He's headed he got behind their house."

9-1-1: "Okay and did she give you a prescription of the clothing?"

Murray:" I didn't get one from her."

9-1-1 "What is your name?"

Murray: "My name is Joseph Murray."

9-1-1: "Ok, is this a good phone number for ya?

Murray: "Yep."

9-1-1: "Ok, I am sending units out to your mother's house."

Murray: "Alright thank you."

9-1-1: " You're welcome. Bye, bye.


The second call played was made by Tammy to dispatch.

Dispatcher: "Fremont County Sheriff’s Office."

Tammy: "Hi, I need to report something."

Dispatcher: "Ok. Go ahead, what is the address?"

Tammy: "Ok... um... 202 North 1900 East. The corner with the broken blinking yellow light on the highway."

Dispatcher: "Is there a suspicious person?"

Tammy: "Yes."

Dispatcher: "Ok. What was she wearing?"

Tammy: "He was all dressed in black, and he had a ski mask on."

Dispatcher: "And you said at the blinking yellow light is where you saw him?"

Tammy: "No. No. I’m when I - He is gone now. Cause, um... I pulled up into our driveway and he - I was getting stuff out of the back seat of my car and suddenly he was there, and he had a paintball gun, like he was going to shoot at me. And I kept asking him what he was doing, so I could tell it was a paintball thing."

Dispatcher: "Ok."

Tammy: "And then he just kept doing it, so I yelled for my husband, and then he took off running around the back of my house."

Dispatcher: "Ok just give me one minute and stay on the line with me."

Tammy:" Ok."

Dispatcher: "That was 200 North, 1900 East?"

Tammy: "Yes."

Dispatcher: "Do you know what direction he was going?"

Tammy: "Um he, he just went behind my house and it's so dark out here and I just went in the house and got my husband and son. And they went out and looked and he was long gone by then."

Dispatcher: "OK."

Tammy: "He was on the north side of my house is where he went to get away."

Dispatcher: "OK."

Tammy: "He didn't say anything, or he just kept at like he was holding the gun like he was you know had a rifle and just shooting at me so, but nothing came out of the gun either, so I don't think it was loaded."

Dispatcher: "OK, what is your name?"

Tammy: "My name is Tammy Daybell."

Dispatcher: "OK, I will pass your information on to my deputies. Um we actually just had a previous call about this individual so they're out in the area looking now."

Tammy: "Yeah, Ok I think it was my son-in-law who lived diagonal from us that called you guys already."

Dispatcher: "Oh, Ok."

Tammy: "I just wanted to make sure it got reported so."

Dispatcher: "Um let's see. And what's your son-in-law's name."

Tammy: "Is Joseph Murray."

Dispatcher:" Ok, yep it was him."

Tammy: "OK."

Dispatcher: "So all right. I have a deputy that will be out at your home here shortly."

Tammy: "OK, Thank you."

Dispatcher: "Yep."

Cannon testified that he responded to the calls around 9 p.m. He said it was dusk and the sun was going down. He drove around the property and searched for the assailant.

The court took a break.

When the court reconvened, Canon reported that following the searches were fruitless. He said that he then had a conversation with Tammy, who recounted the incident. She said she was getting the groceries out of the backseat of her car when she noticed a male standing at the rear of the vehicle. She stated that she faced the gunman, who remained silent. She recalled hearing two popping sounds, yet the gun did not discharge any bullets.

Wixom asked Cannon if he had any contact with Chad. Cannon said that he didn't talk to Chad, but he was standing there listening to the conversation. Cannon said that he found it odd that his wife was victimized, and Chad didn't take any actions to protect her.

Cannon said that then he walked around where the initial area where the vehicle was and looked for any shell casings or paint marks. He said he didn't find anything. He said he then went and talked to Joseph Murray. Murray had told Cannon that he heard Tammy scream and then saw a man run around the north side of the property.

Wixom asked Cannon if he was a part of any other search on the property. Cannon said yes, on January 3rd of 2020. He said they did a search warrant on Chad's home. He helped the FBI shift through the snow for shell casings.

Wixom had no further questions.


Prior began the cross. He asked Cannon about the two separate police reports he filed regarding the incident. Prior said that the first one was very brief, and Cannon agreed.

Cannon testified that he hadn't wore a body cam that day because it was broken.

Prior published a photo of the report. He asked Cannon to read the first line of the first report. " I was dispatched to a suspicious call of a male holding a paintball gun at a lady on 1900 east and 200."

Prior asked Cannon did make it a point to include the word “gun” after “paintball.” Cannon said, “Well, it’s a paintball gun, so…”

Prior asked for the 9-1-1 calls from Tammy and her son-in-law Joseph Murray to be played again.

Cannon testified that a couple of months later he was asked to put more detail in his report, so that was why his second report was longer.

Prior asked Cannon if it was really important that he add more detail or were his supervisors trying to allege that there may have been a gun there.

The second report apparently had incorrect times and showed that Cannon spoke with Tammy four minutes before she made the 911 call. It also listed the suspect as being 6 feet, 200 pounds which was changed from the original that stated the suspect was around 5’10”, 190 pounds. Prior suggested it was changed to better fit Alex’s description. Cannon said not to his knowledge, no.

Prior asked if Joseph Murray heard a gunshot. Cannon said that he did not know and didn't ask him. Cannon said he only asked him what he saw.

Prior asked why it was so important to include the word “gun” but not important enough to ask if the witness heard a gunshot. Prior then asked Cannon what information he had received to lead him toward the gun involved being a gun, rather than a paintball gun. Cannon said it was information he received from Tammy.

Prior played part of Tammy's called to dispatch. Prior said he heard the words "paintball gun" and "paintball thing." He asked Cannon where on the tape the word "gun" was used. Cannon said later on. Prior asked him where that was. Cannon said that it was further on in the recording. Prior said that he didn't hear that, he heard it stop. Cannon said it was because it stopped it.

Prior was done with his questioning.

Wixom was up for the re-cross. He asked Cannon how long after the incident was it that he wrote the second report. Cannon said it was a couple of months. Wixom asked Cannon if he responds to a lot of calls. Cannon said yes. Wixom then asked him if a superior officer asked to write another report, was that something that he'd do. He said yes. Wixom asked Cannon if he was fed information to put in the report. He said no and he agreed that the information he put in there came from his memory.

Wixom asked about Fremont County policy regarding body cams. Cannon said the sheriff’s office doesn't require the use of body cams. Cannon testified that besides a body cam he used police reports to memorialize what had happened in his cases.

Wixom asked Cannon if he could explain his discrepancy in the time stamps of the second report. Cannon said that that was probably when he had been dispatched to the scene.

Cannon testified that there was nothing he discovered that ruled out that the incident “could have” involved a “real gun.”

Wixom asked Cannon why he didn't ask Joe Murray if he heard gun shots. Cannon said that he believed that that detail would have been brought up without asking.

Wixom had no more questions.

Next to testify was Officer Alyssa Greenhalgh. She works as a patrol officer for the Rexburg police department which she has done for 3 years. Before working for Rexburg, she worked at the Freemont County Sherrif's office for 4 years as a patrol deputy.

Greenhalgh responded to the report of Tammy's unattended death. She explained that an unattended death is where a person was not under a physician's care. She said that it is her duty to respond to the scene before the detectives and coroner get there and to look for obvious signs of foul play and then request resources as needed. She mentioned that she searches for clear signs of injury, such as gunshot wounds, and signs of disturbance in homes, like furniture that appears to have been toppled or moved.

Wixom asked Greenhalgh if prior to taking the call, did she ever hear Tammy's or Chad's name before. She said no and testified that she hadn't been familiar with them.

Wood admitted the 9-1-1 call that was place by Garth and Chad Daybell on the day of Tammy's death.

9-1-1: "9-1-1- where's your emergency?"

Garth: "Um, we're at 202 north 1900 east."

9-1-1: "What's going on?"

Garth: "We just found my mom, she's on the ground frozen or she's stiff and i don't know..."

9-1-1: "Are you in Madison County or Freemont County?"

Chad: "Hello, I'm Chad, the husband. Um, she's clearly dead. Um..."

9-1-1: "Sorry. Ok. Are you in Rexburg or... Because your address shows Rexburg but you are in Freemont County?"

Chad: "Yes. Oh no. Oh."

9-1-1: "OK."

Chad: "Yeah, she's not even... She's frozen."

9-1-1: "OK, can i get your name?"

Chad: "Chad Daybell. Oh..."

9-1-1: "OK, Chad. I'm going to get somebody up to you right now, ok?"

Chad: "You know the corner where the blinky yellow light is with the red house?"

9-1-1: "Yes sir. Red house on the corner."

Chad: "Yes."

9-1-1: "Blinking yellow light."

Chad: "Right..."

9-1-1: "OK. We'll get somebody out to you, ok? I am so sorry."

Chad: "Ok..."

9-1-1: "If you need anything else, you call me back, ok?"

Chad: "OK."

9-1-1: "OK. Bubye."

Greenhalgh testified that the call came in around 6am and she didn't think it was light outside yet. She also testified that prior to Tammy's death, she had responded to unattended deaths 5 or 10 times.

Wixom asked Greenhalgh what was the first thing that she observed when she arrived. She said that Garth let her into the house and went into the living room. She said that Chad then came into the living room shortly after she arrived. Greenhalgh said she asked them what was going on and then asked them to show her where Tammy was.

Wixom asked if there was anyone else at the home at that time. She said no. He then asked Greenhalgh if anyone else arrived at the home later. She said yes, the deputy coroner Cammy Wilmore, the coroner Brenda Dy, and some family members.

Greenhalgh said Chad and Garth walked her back to the bedroom at the end of the hallway to the right where Tammy was. Greenhalgh testified that Chad was more emotional and Garth more reserved.

Greenhalgh said that Tammy's body was lying on the bed with her feet hanging off the corner of the bed. The mattress was pulled of the boxspring a little bit and she was covered up with a blanket up to her shoulders.

Greenhalgh said Chad had told her about midnight Tammy had woken up with a coughing fit and she had vomited on the bedroom floor and moved on to the bathroom down the hallway and continued vomiting. Greenhalgh said that Chad told her that he got up to help Tammy clean up, put her back to bed and then they both went back to sleep. He then had told Greenhalgh that at 5:40am he felt the blankets shift off of him in bed, woken up and thought that Tammy had fallen off the bed, so he had told Tammy to get back on the bed. When Tammy didn't answer him, Chad said he stood up, turned the lights on and found her unresponsive. He said her feet were wrapped in blankets and were on the bed, but her head was on the floor. He said that he then called Garth for help, and they put her back on the bed.

Greenhalgh said that she first checked Tammy for a pulse, which she did not have. She said that Tammy's body was colder than the room temperature and stiff. She said that Tammy had pink foam coming out of her mouth and down the side of her face and she was deceased.

Greenhalgh said that Chad told her that Tammy had been suffering from a “pretty bad cold” but did not like visiting the doctor. He had told Greenhalgh that Tammy had recently fallen and visited the doctor, and she was going through menopause and suffered from fainting spells.

Greenhalgh requested for assistance from detectives in investigating the death. She said that the detectives had told her to take photos and allow the coroner to decide whether an autopsy was needed.

Greenhalgh testified that she found nothing suspicious about the scene, based on info provided by Chad and no one else provided any info about Tammy or her death. She said that Garth was present for the conversation and never said anything.

Wixom admitted photos of Tammy's body that Greenhalgh had taken. Greenhalgh said that the first photo was of Tammy's body lying in bed. 

Greenhalgh said that the second photo was a close up of Tammy's face and the foam. She said that the third photo was how Tammy's arms were lying, uncovered by the blanket. 

The fourth photo she said was a full body photo of Tammy's body totally uncovered by the blanket. She said the photo also showed a little bit of the mattress.

She said that the fifth photo was of Tammy's hair and also right ear, which had some discoloration to it. 

The next photo she said was a close up of Tammy's face where blood could be seen around her mouth and nose and that it had traveled down the left side of her face.

She said the next photo was to show the foam had run down the side of her face along with depicting a little more of the blood.

She said that the eighth photo showed Tammy’s face after the coroner wiped some of the foam and blood away.

The last photo Greenhalgh said was of Tammy after she arrived at the coroner's office. She said that some time had passed, and the photo showed bruising and color changing that had happened on her skin. She said that Tammy's face, neck, mouth, chest and chin area showed bruising. Greenhalgh testified that the pink foam was gone and that she hadn't removed it.

Greenhalgh said that there was lividity on the back of Tammy's legs and lower back. She said that lividity is bruising from blood pooling following death. Greenhalgh said that this showed Tammy was on her back for a significant amount of time after she died.

Greenhalgh testified that she never discussed the possibility of an autopsy with Chad and never heard anyone else do so either.

Wixom asked Greenhalgh if she did a medicine check and if she determined if Tammy had been on any medicine. Greenhalgh said yes, Chad had told her that Tammy was taking prescription as well as over the counter medication for depression. Greenhalgh testified that found no evidence that Tammy may have overdosed on any of those meds. Greenhalgh also testified that she never found anything suspicious at that time.

Wixom was finished with his questioning.

Prior was up for the cross. He said that it was determined an autopsy would only be performed if the Daybell family wanted one and they did not. Greenhalgh agreed.

Greenhalgh confirmed what meds Tammy had been taking. Prior said that Chad had told Greenhalgh that Tammy was “experimenting” with essential oils. Prior said that there was also cough medicine found next to the bed. Greenhalgh said yes. Prior said that among the meds found was also an essential oil “respiratory blend” and a supplement to treat bruising and swelling. Greenhalgh agreed.

Greenhalgh agreed that Chad was more “shook up” and “disturbed” than anyone else in the house.

Prior suggested that Tammy was dealing with “unexplained falls.”

Greenhalgh confirmed that was not using a body cam or recorder while present for the investigation into the unattended death.

Prior suggested that the pink foam was from anemia. Greenhalgh said she could not confirm that, but she did confirm that there were no signs of a struggle in the home.

Prior asked Greenhalgh if she was aware that Tammy’s daughter, Emma, had said that Tammy had “slowed down” recently. Greenhalgh said yes, she found out through the coroner.

Prior then read from a report about something Greenhalgh said she didn't remember. She then informed Prior that he was reading the coroner’s report.

Prior was done with his questioning.

Wixom asked Greenhalgh if she had information outside of Chad telling her that Tammy was the one who took the nonprescription treatments found at the home. She said no, she didn't know who had been taking the medicines and for how long.

Greenhalgh testified that Chad had never told her that Tammy had seizures and confirmed it was possible Chad told her one thing and the coroner another.
